This agreement is for one photography booking, where the client is an individual or a business. It is not a model release and not a licence to sell images through a stock or picture agency. It is drafted for England and Wales.
Who is this template for?
Suited to photographers booked for weddings, portraits and family sessions, events or commercial work, and to clients who want the shoot, fee, cancellation terms and image rights set out in writing.
What does the template include?
The document is made up of numbered sections:
- Parties — photographer and client, with a tick box for a consumer or a business client.
- The Shoot — tick the type of shoot (wedding, portrait or family, event, commercial), with date, time, hours, location, second photographer option and requested shots.
- Deliverables — approximate number of edited images, delivery time and tick options for online gallery, digital files and prints or album.
- Fee and Payment — total fee, deposit, balance, expenses and tick whether VAT is included.
- Cancellation and Rescheduling — one free move, a cancellation charge scale by notice given, and a tick box for consumers who ask work to start early.
- Photographer Unavailable or Equipment Failure — back-up equipment, replacement photographer and refund.
- Copyright, Licence and Portfolio Use — the photographer owns the copyright; tick the client’s licence (personal, personal plus own social media and website, or commercial) and the photographer’s portfolio use option.
- Liability — reasonable care and skill, with consumer and business positions.
- Data Protection and Force Majeure — use of personal data and images, and events outside the parties’ control.
- General — whole agreement, changes in writing, England and Wales law and courts.
- Signatures — photographer, client and a second client if any.
