This deed of release template, made as a deed, lets a landlord, lender or other creditor release a guarantor from a guarantee of a tenancy, a loan or another contract. The creditor, the guarantor and the principal (the tenant, borrower or other party whose obligations were guaranteed) all sign it.
Who is this template for?
It suits creditors and guarantors agreeing to end a guarantee, for example when a tenant’s guarantor steps away or a loan guarantee is lifted. As the document itself states, it does not create a guarantee: a replacement guarantor signs a new guarantee of their own.
What does the template include?
The document is made up of numbered sections:
- Parties — details of the creditor, the guarantor and the principal, each an individual or a company, and the date of the deed.
- The Guarantee — the date of the guarantee, tick boxes for a tenancy, a loan agreement or another contract, and its title and date.
- The Release — the release date and a choice between a full release and a future-only release, with a table of sums known to be due and an option to limit remaining liability to them.
- The Principal’s Obligations Continue — the principal consents and stays fully bound, and the creditor keeps its rights against the principal, any other guarantor and any security.
- The Guarantee Document — whether the original guarantee is returned, destroyed or kept marked “released”, and within how many days.
- Replacement Guarantor — whether a replacement guarantor is required, with the release waiting until the new guarantee is received.
- General — binding as a deed, entire agreement, changes in writing, and the law and courts of England and Wales.
- Execution — deed signature blocks for the creditor, the guarantor and the principal, each with a witness or second company signatory.
