This agreement is for hire between two businesses, where the Hirer is a company, LLP or other body corporate. It is not for hire to individuals, sole traders or ordinary partnerships, and it is not a hire-purchase or lease-to-own agreement.

Who is this template for?

Businesses hiring out tools, machinery or other equipment to another company or LLP that want the hire terms, charges and responsibilities for care, insurance and return set out in writing.

What does the template include?

The document is made up of numbered sections:

  • Parties — the owner and the hirer, with the hirer’s confirmation that it is a body corporate hiring for business purposes.
  • The Equipment — a table of description, serial number, condition at hire and rate.
  • Hire Period — start date, and a tick box for a fixed period or continuing hire with a notice period.
  • Delivery and Collection — tick whether the hirer collects or the owner delivers, with site address and delivery charge.
  • Charges and Deposit — deposit, invoicing, payment days and late interest.
  • Use and Care — the hirer’s duties on use, operators, upkeep, sub-hire and inspection.
  • Risk, Insurance and Damage — tick whether the hirer or the owner insures, with cover charge, excess and replacement value.
  • Breakdown and Return — what happens on a fault and on return of the equipment.
  • Liability — the owner’s liability cap, the owner’s promises about the equipment and the hirer’s indemnity.
  • Termination — when either party may end the hire.
  • General — whole agreement, notices and England and Wales law.
