This horse loan agreement template sets out the terms on which a horse owner lends a horse to a borrower, either on a full loan at the borrower’s yard or on a part loan at the owner’s yard. The horse remains the owner’s property throughout. It is drafted for use in England and Wales.
Who is this template for?
It suits private owners and borrowers agreeing a full or part loan. As the document itself states, it is between private individuals and is not for a riding school or anyone who hires out horses in the course of a business.
What does the template include?
The agreement is made up of numbered sections:
- Parties — contact details for the owner and the borrower and the date of the agreement.
- Type of Loan — tick one: a full loan or a part loan, with part-loan days and times.
- The Horse and Where It Is Kept — name, passport number or UELN, microchip, description, agreed value, known vices and health conditions, tack lent and the yard details.
- Term — start, end and review dates, with extensions only in writing.
- Use of the Horse — tick boxes for hacking, flatwork, jumping and competition, named other riders, hat requirements and a ban on sub-loaning, breeding or selling.
- Costs — a tick table of who pays livery, feed, farrier, worming, dental, vet care and insurance, and any monthly part-loan contribution.
- Insurance — tick one: owner or borrower insures the horse, plus the borrower’s public liability insurance.
- Vet Care, Emergencies and Unsoundness — emergency contacts, the borrower’s treatment limit, responsibility for loss caused by negligence, lameness and decisions on putting the horse to sleep.
- Ownership, Passport and Option to Buy — the horse stays the owner’s property, who holds the passport, and an optional tick-box option for the borrower to buy at a stated price.
- Ending the Loan and Return of the Horse — a notice period, immediate ending for welfare, safety or serious breach, return condition and a collection period.
- Disputes and General — optional mediation, the agreement is personal to the borrower, changes in writing and governing law of England and Wales.
- Signatures — signature blocks for the owner and the borrower.
