This deed of variation changes some terms of an existing lease while the lease carries on. It is for a lease of business or other non-residential premises in England and Wales. It is not for an assured or assured shorthold tenancy or a long lease of a home, and it should not be used for a change that in substance ends the lease and grants a new one, such as one that extends the term or changes the land let.
Who is this template for?
Suited to landlords and tenants of commercial premises who have agreed to change particular lease terms, such as wording or rent, and want the agreed changes recorded in a deed, with any guarantor joining in.
What does the template include?
The document is made up of numbered sections:
- Parties — landlord, tenant and any guarantor, with company numbers where relevant.
- The Lease — date, original parties, property, term, current rent and title number if registered.
- The Variations — an effective date and a table of lease clause, existing wording and new wording, with space to mark a term as deleted.
- Rent — tick whether the rent is unchanged or changed, with the new rent, start date and next review date.
- Guarantor and Former Tenants — tick options for whether there is a guarantor, who joins in and consents, and whether a former tenant or guarantor of a former tenant is still bound.
- The Lease Continues — the lease carries on as varied, with a whole-agreement statement and each party paying its own costs.
- Land Registry, Renewal Rights and Lenders — tick whether the lease is registered and, if so, the days for the tenant to apply; notes on renewal rights and lender consent.
- Execution — signing as a deed, with witness details for individuals and company signing notes.
