This declaration of trust template, made as a deed, records who owns what when two to four people buy a home or other property together and want their shares fixed in writing. The owners hold the legal title on trust as tenants in common in the shares they set out.
Who is this template for?
It suits co-buyers who are buying a property together and want their shares recorded. As the document itself states, it is not for a divorce, dissolution or other financial-remedy arrangement, and it gives no tax advice.
What does the template include?
The document is made up of numbered sections:
- The Property — address, title number, freehold or leasehold tick boxes, lease details and completion date.
- The Owners — details of up to four owners and the date of the deed.
- Declaration of Trust — the owners hold as tenants in common, not joint tenants, with no right of survivorship.
- Contributions and Shares — a table of each owner’s deposit, other purchase costs and share, with a tick-one choice on whether shares are fixed or deposits are repaid first on a sale or buy-out.
- Mortgage and Lender — no mortgage or a charge to a named lender, how payments are split, and whether the lender’s consent is needed.
- Occupation and Running Costs — who lives there, running costs, and an optional occupation payment.
- Selling and Buy-Out — a leaving owner’s notice, an offer period, market valuation by a chartered surveyor and a sale if no buy-out completes.
- Death of an Owner — the share passes through the estate, with an option for the survivors to buy it and an optional tick box for a Land Registry restriction.
- Disputes and General — good-faith discussion then mediation, entire agreement, changes in writing, and governing law of England and Wales.
- Execution — signature and witness blocks for up to four owners.
