This Tenancy Guarantor Agreement sets out the terms on which a guarantor agrees to cover a tenant’s rent and other obligations under a tenancy. It defines the guarantee, the liability cap or unlimited liability, how long it lasts and when the landlord must tell the guarantor about problems, for landlords, letting agents and guarantors in England and Wales.
Who is this template for?
It is designed for landlords and letting agents who require a guarantor for a tenant, and for the guarantors themselves, often a parent or relative of a student or first-time renter. It sets out what the guarantor is responsible for, and it should be read alongside the tenancy agreement it guarantees.
What does the template include?
The agreement is organised into numbered clauses and covers the key terms of a tenancy guarantee:
- Parties — the landlord, tenant and guarantor.
- The Tenancy Being Guaranteed — the tenancy that is covered.
- Guarantor’s Obligations — rent, other sums and the tenant’s obligations, which the landlord can enforce against the guarantor without first pursuing the tenant.
- Cap on Liability — tick box for unlimited liability for the tenancy, or a maximum amount and period.
- Duration of this Guarantee — it lasts while the tenancy continues as a periodic tenancy, unless the landlord releases the guarantor; the guarantor cannot withdraw alone.
- Notification — the landlord notifies the guarantor of arrears of a month or more, legal action, or variations that could increase liability.
- Independent Legal Advice — the guarantor’s tick box to confirm advice was taken or the opportunity was declined.
- Governing Law — England and Wales jurisdiction.
- Signatures — signatures, with a witness to the guarantor’s signature.
Easy to customise
The template works in Microsoft Word, Google Docs and LibreOffice. Simply fill in the highlighted fields, tick the relevant checkboxes and edit any clauses to suit your arrangement. No special software is required.
Format and scope
The document downloads as an editable Word (.docx) file and a PDF, formatted to A4. It is drafted for use in England and Wales with light, general legal references.
