This Transfer of Equity agreement records the principal terms agreed for adding or removing an owner of a property, subject to contract. It covers the nature of the change, any consideration, the existing mortgage and the legal formalities, for couples, families and co-owners in England and Wales. It is not the Land Registry transfer deed (TR1) and does not by itself change who owns the property: the formal transfer must be signed and registered at HM Land Registry, and any mortgage lender’s consent must be obtained first.

Who is this template for?

It is designed for property owners changing who is on the title, for example adding a partner, removing a former partner or transferring a share to a family member. It is often used following marriage, separation or a gift of a share in a home.

What does the template include?

The document is organised into numbered clauses and covers the key points to agree:

  • Important Notice — that this is a record subject to contract, not the transfer deed, and that registration and lender consent are needed.
  • The Property — the property affected.
  • Current Owner(s) — the existing legal owners.
  • Nature of Transfer — tick boxes for adding an owner, removing an owner or another arrangement.
  • Incoming Owner (if adding) — any new owner, and whether the owners will hold as joint tenants or tenants in common, with shares.
  • Consideration — nil or financial consideration, with a reminder to take tax advice.
  • Existing Mortgage — whether a mortgage exists, and that the lender’s written consent is needed before completion.
  • Deed of Trust (if applicable) — a tick box for whether a separate declaration of trust will be prepared by solicitors.
  • Legal Formalities — the formal transfer must be prepared by a solicitor and registered, and how the costs are borne.
  • Governing Law — England and Wales jurisdiction.
  • Signatures — the parties confirm agreement to the principal terms.
