Who is this template for?

It suits friends, family members or others who have paid in full for a shared vehicle, caravan, boat or horse. As the document itself states, it is not for an asset bought on finance or hire purchase, a ship or aircraft on an official register, or an asset the owners intend to hire or let out.

What does the template include?

The agreement is made up of numbered sections:

• The Owners — names, addresses and contact details for up to four owners and the date of the agreement.
• The Asset — tick boxes for the type of asset, a description, registration, VIN, hull or passport number, purchase price and date, and where it is kept.
• Registration, Keeper and Insurance — the registered keeper or licence holder, insurer and named drivers or riders, confirming the named person holds that position for all the owners.
• Shares and Contributions — a table of each owner’s contribution and percentage share, with fallbacks if shares are left blank.
• Running Costs — a table for insurance, tax and licence fees, storage or mooring, servicing or a horse’s care, repairs and trip fuel, with recovery of unpaid shares.
• Use, Care and Condition — tick one: a fixed rota or advance booking, plus each user’s duties, liability for uninsured damage and fines, and limits on hiring out, lending or taking the asset abroad.
• Repairs and Improvements — an approval threshold, with a choice of approval by every owner or by owners holding more than half the shares, and rules for urgent repairs.
• Selling the Whole Asset — sale only with every owner’s written agreement and the order in which sale proceeds are applied.
• An Owner Who Wants to Leave — valuation by agreement or an independent valuer, a first-refusal period for the other owners, then a choice of selling the share to an approved new owner or selling the whole asset.
• Death or Bankruptcy of an Owner — the share passes through the estate, with a chance for the other owners to buy it.
• Disputes and General — optional mediation, whole agreement, changes in writing and governing law of England and Wales.
• Signatures — signature blocks for up to four owners.
