This executors’ licence to occupy template is for personal representatives who let a family member or beneficiary live in the home of a person who has died until it is sold or transferred. Who is this template for?

It suits executors and administrators, and the relative or beneficiary staying in the property. As the document itself states, it is for a property in England and is not intended as a tenancy or a letting at a market rent. It is not for a property in Wales, and it is not suitable where the occupier is the only representative.

• Marketing, Sale and Leaving — co-operating with viewings and sale, the representatives’ notice to leave, leaving the property clean, and belongings left behind.
• Nature of This Licence — a personal licence that is not intended to be a tenancy and does not change the occupier’s entitlement under the will or intestacy.
• Signatures — signature blocks for two representatives and the occupier.
• Consent of Other Beneficiaries (optional) — a block for other beneficiaries to confirm they know of and consent to the licence.
