This agreement is for an employee lent by their employer to work for another organisation within the United Kingdom for a fixed period. It is not for agency workers, for a permanent transfer of the employee, or for work outside the United Kingdom.
Who is this template for?
Home employers, host organisations and employees arranging a temporary secondment who want the roles, costs and responsibilities of each of the three parties written down and signed.
What does the template include?
The document is made up of numbered sections:
- Parties — the home employer, the host organisation and the secondee, with contact people.
- The Secondment — purpose, role, supervisor, place and hours of work, start, end and review dates.
- Employment, Pay and Costs — the secondee stays employed by the home employer; tick either that the host reimburses salary and employment costs (with amount and invoicing) or that there is no recharge; who pays expenses.
- Day-to-Day Work, Conduct and Discipline — the host directs daily work and safety; the home employer alone handles discipline and grievances.
- Confidentiality, Intellectual Property and Data — tick whether work produced belongs to the host or the home employer, plus data protection.
- Insurance and Liability — employers’ liability and public liability cover and each party’s responsibility for its own breach.
- Ending the Secondment and Return — notice in days, immediate ending for serious cases, and return to the home employer.
- The Secondee’s Consent — the secondee’s agreement and confirmation they could take advice; England and Wales law.
- Signatures — signature blocks for all three parties.
