Who is this template for?

It suits neighbours on a shared drive or private road, and residents’ groups who want upkeep and costs in writing. As the document itself states, it does not grant, change or give up any right of way: those rights come from the title deeds, and a new right needs a deed of easement.

What does the template include?

The agreement is made up of numbered sections and a schedule:

• The Owners and Their Shares — a table of properties, owners, emails and percentage shares, and the named co-ordinating owner.
• The Driveway or Road — a description of the shared area, including verges, drains and lights, shown by plan or description.
• Routine Maintenance — upkeep such as sweeping, potholes and gritting, a yearly spending limit and the days each owner has to pay.
• Major Works — written quotes, a tick-one approval choice by majority share or all owners, emergency work, and recovery of unpaid shares.
• Maintenance Fund — a tick-one choice of a yearly fund held in a separate bank account or no fund.
• Use, Parking and Damage — no blocking of access, brief stops for deliveries, skips and scaffolds by agreement, and paying for damage caused.
• Insurance — a tick-one choice of shared public liability insurance or each owner checking their own home insurance.
• Sale or Letting of a Property — asking a buyer to sign the adherence form, when the seller is released, and responsibility for tenants.
• Disputes, Changes and Ending — discussion, then an independent surveyor or mediator if agreed, changes in writing, ending on agreement or adoption of the road, and governing law of England and Wales.
• Signatures — signature blocks for the owners of up to four properties.
• Schedule: Adherence Form — a form for a buyer and the co-ordinating owner to sign so the buyer joins the agreement.
