This agreement records changes to an employee’s terms of employment that the employer and employee have agreed together. It is not for imposing a change by dismissing and re-engaging the employee, for reducing pay below the National Minimum Wage, or for ending the employment.
Who is this template for?
Employers and employees who have agreed a change such as different hours, pay, place of work, duties, probation or notice period and want it recorded in a signed document, including a change that follows a flexible working request.
What does the template include?
The document is made up of numbered sections:
- Parties and the Existing Contract — the employer, the employee, and the date, job title and start date of the existing contract.
- The Changes — a table of existing and new terms for hours and days, pay, place of work, duties or job title, probationary period, notice period and any other term, with tick boxes for permanent or temporary changes and for a flexible working outcome.
- Effective Date — the date the changes apply from, without affecting rights already built up or continuous employment.
- Consent — the employee confirms they had time to consider, could take advice and agreed freely, with the date the proposal was given and any payment or benefit for the change.
- Written Statement of the Changes — how the employer gives the written statement of changed particulars.
- Statutory Rights — confirms no statutory right is removed and pay, holiday and working time protections stay at the legal minimum or above.
- The Rest of the Contract — other terms stay unchanged; further changes must be in writing; England and Wales law.
- Signatures — signature blocks for the employer and the employee.
