This Prenuptial Agreement allows a couple intending to marry to record how their finances and assets should be treated, both during the marriage and if it breaks down. It is prepared for use in England and Wales and includes the disclosure and independent-advice steps a court looks at. A prenuptial agreement is not automatically binding: a court is not bound by it, and may give it weight only where it was freely made with independent advice and full disclosure, and signed well before the marriage.
Who is this template for?
For couples planning to marry who wish to record their intentions for pre-marital or inherited assets and clarify financial expectations — for example where one party owns a business, property or has children from a previous relationship.
What does the template include?
The agreement is organised into clearly numbered sections:
- Important Notice — that a prenup is not automatically binding, and that each party must take independent legal advice.
